General Terms and Conditions of Sale

These General Terms and Conditions of Sale govern the sale of merchandise or services by
Carpi Moto s.r.l. via Pedullà, 75 - 16165 Genova - Italy, f.c. & VAT number : IT 01386060998 ; REA Genoa n°405685 ("Carpi Moto" or "we") to Customer ("you") through the www.carpimoto.it and www.carpimoto.com web sites ("site").

1) Orders

1.1) You can buy only products or services present in the site.
1.2) Your order has been correctly placed if you receive an automatic e-mail generated by our server. This is the prove that your order has been received but not that it is confirmed yet.
1.2) Order Status - Tracking: Tracking on-line pages shows order status step by step. Visible pages are Three. 'ON-LINE FILL OUT ORDER': this is the page automatically generated using personal and product data filled by the customer. 'ON-SITE CHECKED ORDER': it is the page generated by a Carpi Moto operator after the order has been checked. This page states we received your personal data and that we confirm your product's order. 'SHIPPED ORDER': it is the page generated after the order has been shipped.
'ON-SITE CHECKED ORDER' will show a totally or partial order rejection.

2) Availability and Delivery Time

2.1) The availability is daily updated, displayed in each item's product detail page and also in the basket.
The availability estimate on each item's product detail page refers only to how long it will take that item to leave us once you place your order. It does not include the time your order will take to reach you once we ship it. Shipping time depends upon the shipping option you choose.
In any case order confirm will advise about delays or problems.
2.2) Carpi Moto ships in one solution once every item is in stock. Extremely urgent parts can be shipped separately on demand, paying an extra delivery charge.
2.3) Unless customer's written communication indicating a term longer than 30 business days, or unless availability is more than 30 business days Carpi Moto is bound to: 2.3.A) to carry out order as soon as possible but within 30 business days, from the day after the order or within availability period (you can check it in every product's detail); 2.3.B) After the delivery term is gone, Carpi Moto informs the customer, who can decide to get on waiting, to totally or partially cancel his order, or/and to receive money back (only for advance payment orders); 2.3.C) unless customer's consent Carpi Moto could not carry out orders with different products even if their quantity or their value is equal or higher.
2.4) Advance payment orders will be prepared only after receiving the bank's receipt and shipped only after payment would be recorded on our account.

2.5) Expected delivery for Italy: Ground Service usually takes 24/48 hours.

2.6) Expected delivery for Outside Italy destinations is:

  • Europe: Air Service usually takes 24/48 hours
  • Europe: Ground Service usually takes 4/5 days
  • Outside Europe: Express Air Service usually takes 48 hours, Standard Air Service 4/5 days.

4)  Prices, Taxes, Currency.

4.1) Prices are in EURO currency.
4.2) Every order which destination is inside EU includes VAT, Every order which destination is outside EU does not include VAT (is tax excluded).
Therefore :

  • European Union Countries: our web site prices are tax included.
  • Outside European Union Countries: our web site prices are tax excluded.

4.3) Every order is billed. For every order which destination is inside EU we will send by email a purchase receipt. For every order which destination is outside EU we will issue an invoice.
Invoice is billed using data filled in the "billing address fields". After invoice is drawn, no correction could be done

5) Return Policy

5.1) You may return any unused merchandise in its original conditions within 30 business days of the date you received the item and we will issue a full refund for the price you paid for the item.
5.2) Return policy applies to every person who is a final consumer, customer who buy products outside their business.
5.3) Return policy does not applies to Professional Consumers, customers who buys products for their business.
5.4) Return Policy applies to any unused merchandise in its original conditions.
5.5) Return Policy does not apply to used or unsealed products (for example you can't try a muffler on your bike).
5.6) Return Policy does not apply to custom made products. It does not apply in the case personalized products. The art. 45 of the Consumer Code clearly defines personalized goods as those products born following "the consumer's instructions", therefore not prefabricated but produced on the basis of an individual choice or decision. We also intend to specify that in order for the products to be defined as "customised", the modifications requested by the consumer must be such as to involve irreversible modifications of the standard product from a technical or economic point of view (excessive costs for restoring the basic model). By way of an explanatory and non-exhaustive example, requests for modification of the hydraulic lines (e.g. Fren Tubo brake and clutch lines) can be identified as "customization" requests, i.e. always by way of an explanatory and non-exhaustive example: the change of color of the sleeve, the addition of a sleeve if not foreseen, the modification of the length of the original line, the modification of the color of the fittings, the modification of the type of fitting (e.g. following the replacement of the master cylinder or caliper), etc etc .
5.7) To return first contact us by e-mail, or a recorded-delivery service, we will provide you a RMA number (Return Material Authorization) to use for returning parts, then ship products to Carpi Moto s.r.l. - via Pedullà, 75 - 16165 Genoa - Italy, insert a copy of the original bill, a letter where you declare the parts you want to return, your bank account coordinates (only for bank transfer advance payment)
5.8) Carpi Moto will refund within 30 business days the date of arrival to our warehouse the whole amount of the products except shipping costs and any import or export custom duties. If the purchase is part of a promotion where one or more items are given away as part of the primary products or sold at a special price, return items should be the whole promotion items; if the promotion purchase is composed by some products (for example a pair of tires), return items should be the whole promotion items as well.
5.9) We will not accept returns not authorized by a RMA number, COD return shipping, or at consignee's expense.

8) Guarantee :

8.1) Every Product sold by Carpi Moto is covered by One Year Limited Manufacturer's Conventional Guarantee, according to the italian law DL 24/02, Final Consumers will benefit of Two Years Limited Conformity Guarantee. Customer will access guarantee services keeping shipping receipt.

8.2) The manufacturer's conventional warranty is provided according to the methods illustrated on the website or in the documentation present inside the product packaging. If, after the warranty check serviced by an Authorized Service Center or by the Manufacturer or by Carpi Moto srl, the defect should not be covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and restoration, as well as the costs of transport, if supported by Carpi Moto srl .

8.3) The 24-month warranty pursuant to Italian Law Decree 24/02 applies to products that present a lack of conformity, provided that the product itself is used correctly, respecting its intended use and as provided in the attached technical documentation. This guarantee is reserved for the private consumer.
It is specified that for private consumers we mean the physical person who buys goods for purposes not related to his professional activity, and / or makes the purchase without indicating in the order form the VAT number or the Tax Code; the private consumer thus benefits from the seller's guarantee (two years from delivery) of which one year of the manufacturer's conventional warranty (one year from delivery); it is specified that for Professional User we mean those who purchase for professional purposes, and / or by indicating in the order form the VAT number or the Tax Code; the professional user only benefits from the manufacturer's standard warranty (1 year from delivery, unless extensions granted by the manufacturer).
In case of lack of conformity, Carpi Moto s.r.l. provides, at no cost to the Customer, to restore the conformity of the product by repair / replacement or price reduction, until the contract is terminated. If, after the warranty check serviced by an Authorized Service Center or by the Manufacturer or by Carpi Moto srl. the defect should not result in a lack of conformity pursuant to Decree 24/02, the Customer will be charged for any costs of verification and restoration, as well as transport costs if incurred by Carpi Moto s.r.l. .
Wearable parts, (for example, but not limited to, are batteries, brake pads and discs, engine oil, fluids, brake master cylinders, starters and all electrical parts in general, transmission parts, filters) are covered by guarantee against the premature malfunction due to manufacturing defects like all the other products. However, due to the fact that their use determines their lifetime, they are subject to limitations.
By way for example, but not limited to: 1) brake pads and discs, transmission parts - the warranty does not "guarantee" the use for the entire duration without travel limits, these products are consumed on the basis of km traveled or use ; 2) engine oil and fluids - the warranty does not "guarantee" the use for the entire duration without travel limits, the oil and liquids degrade according to the kilometers traveled or to the use or to the operating temperatures; 3) batteries - the warranty does not "guarantee" the use for the entire duration without limits of distance, or for improper use, for example are excluded 3a) Failure resulting from the wear and tear, misuse and negligence either before or during use. Examples are overcharging, deep cycling, sulphation and undercharging, 3b) Failure resulting from the use of any fluids other than distilled or deionised water, or from any action not recommended, 3c) Use of a battery type on a vehicle for which it is not recommended, or on which it has been installed and commissioned incorrectly.

8.4) The replacements in case of DOA (Dead On Arrival: product not working on delivery) occur only if expressly provided by the manufacturer. The timing of replacement or possible repair of the product depends exclusively on the policies of the manufacturer.

8.5) In the event that, for any reason, it is not able to provide its customer with a product under warranty (restored or replaced), Carpi Moto s.r.l. may proceed at its own discretion to terminate the contract, or to return the amount paid, or to reduce the price, or to replace it with a product of equal or higher characteristics.

8.6) No damage can be requested to Carpi Moto s.r.l. for any delays in carrying out repairs or replacements.

8.7) In the cases in which the application of the guarantees foresees the return of the product, it is necessary to contact by telephone or by email message Carpi Moto s.r.l. , an operator will provide all the necessary information. At the time of the call, or in the email you need to provide / indicate the details necessary to identify the purchase (eg receipt, invoice, receipt, certificate of guarantee) issued by Carpi Moto srl Carpi Moto reserves the right not to provide warranty to the product or to the motorcycle in the absence of the purchase receipt or of the guarantee certificate. The operator will provide a RMA number (Return Authorized Goods) to be placed outside the parcel used for the return. Shipments without the RMA number over the parcel will not be accepted by the Carpi Moto Warehouse. The goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc ...); to limit damage to the original packaging, we recommend, to put it in a second box or in the packaging used for forward shipping; in all cases, the affixing of labels or adhesive tapes directly onto the original packaging of the product should be avoided.

8.8) For Any service carried out by personnel not authorized by Carpi Moto s.r.l. the warranty will expire immediately.

8.9) A warranty intervention leaves the duration of the product warranty period unchanged.

8.10) The warranty will not be valid in cases where the failure of the product is caused by improper use, incorrect installation, assistance, maintenance or repair by technicians not authorized by Carpi Moto s.r.l. .

9) Homologation: Except products whose description or detail form mentions the words "homologated" or "street legal", products that we sell are not street legal, they are not for highway use but only for exibition in private places. The Homologation Approval is limited to the countries belonging to the European Union or to the countries included in the type approval documents.

10) DISCLAIMER OF LIABILITY:

10.1) INFORMATION ON THIS WEB SITE: We attempt yo keep this web site up-to-date as possible we can. But do to the changing nature of these typology of products, always chasing improvements and state of the art manufacturing we can not guarantee that all information or pictures are describing products as really they are or as really they will be delivered.
Prices are subject to change without notice, we can not be liable for any existing pricing changes, mistakes, typos, misprints or updates.
Pictures are for reference only and subject to change without notice.
Carpi Moto can not be liable for any outcome or damage resulting from information found in this web site. Product application are suggested by every manufacturer, we do not assure correspondence with the OEM part.

10.2) PRODUCTS: Except products whose description or detail form mentions the words "homologated" or "street legal", products that we sell are not street legal, they are not for highway use but only for exibition in private places. The Homologation Approval is limited to the countries belonging to the European Union or to the countries included in the type approval documents.
Riding a bike is really hazardous, We can not be liable for any outcome, damage, injury or death occurred while using our products.
Using product not legal for street use could be considered a crime or be persecuted.

10.3) GOVERNING LAW AND CHOICE OF LAW COURT:
10.3.1) Contract between Customer and Carpi Moto s.r.l. is concluded in Italy and it is subject by the italian law. The parties consent to jurisdiction of venue exclusively in Genova, Italy .
10 .3.2) If any part of these Terms is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions.

10.4) The document in this page "General Terms and Conditions of Sale" is a short english translation of the italian document "Condizioni di Vendita" which is the only legal document stating our General Terms and Conditions of Sale.
